Chapter 7 bankruptcy allows individuals to discharge most unsecured debts, such as credit cards and medical bills, through a court-supervised liquidation process. Non-exempt assets may be sold by a trustee to repay creditors, but many filers keep most or all of their property under exemption laws. It provides a relatively quick path to a financial fresh start but remains on a credit report for up to ten years.

Chapter 13 bankruptcy involves a repayment plan that allows individuals with regular income to reorganize and pay off some or all of their debts over three to five years. It can stop foreclosure, repossession, and wage garnishment while allowing debtors to keep their property. At the end of the plan, qualifying remaining unsecured debt may be discharged.

Often, we can negotiate directly with creditors to reduce the total amount owed, extend payment terms, or lower interest rates outside of formal bankruptcy proceedings. This approach may prevent lawsuits and avoid the long-term credit impact of bankruptcy. Skilled negotiation often relies on presenting a client’s financial hardship and ability to make realistic payments.
